What about other tracking technologies, like web beacons?

Cookies are not the only way to recognize or track visitors to a website. Information on the processing of personal data pursuant to Regulation (EU) 2016/679 of the European Parliament and of the Council General Data Protection Regulation (GDPR)

The company The JOY, s.r.o. respects the privacy of individuals and treats personal data responsibly. In accordance with the applicable legislation in the field of personal data protection, we inform you how we process personal data. The legislative framework for the protection of personal data is Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46 / EC (General Data Protection Regulation). (GDPR Regulation) and Act no. 18/2018 Coll. on Personal Data Protection and on Amendments to Certain Acts (hereinafter referred to as the “Personal Data Protection Act”).

Personal data - data relating to an identified individual or an identifiable individual that can be identified directly or indirectly. The data subject is any individual whose personal data are processed.

What personal data do we process and for what purpose?

  • Electronic contact form.
    
For the purposes of providing information through the contact form located on the Operator's website, an online identifier and data within the items of the contact form are processed. The legal basis for the processing of personal data is the legitimate interest of the Operator in accordance with Art. 6 par. 1 letter (f) the GDPR Regulation. The legitimate interest of the Operator is the support of services to customers and potential customers through the contact web form. The provision of personal data by the data subject for the above purpose is voluntary, but without this data, it is not possible to register or process the request in question. Personal data is stored for a period of 1 month from the processing of the request/message in question sent via the contact form. After this time, the personal data provided are deleted. In the event that the data subject confirms the possibility of using the data to create an order, personal data are processed within the framework of pre-contractual relations within the meaning of Art. 6 par. 1 letter (b) the GDPR Regulation.
  • Operation of profiles on social networks.
    For the purposes of supporting the sale of the Operator's products and services, as well as the use of the social network environment as a communication channel with the customer, resp. potential customers, the Operator manages its profiles on social networks (eg Facebook, Instagram). The legal basis for the processing of personal data is the legitimate interest of the Operator in accordance with Art. 6 par. 1 letter (f) of the GDPR Regulation. The legitimate interest of the Operator is to increase awareness of the Operator's products and services in the online environment. Personal data is stored until the contribution is removed from the social network by the person concerned or the contribution is removed by the Operator.
  • Contractual relations.
    For the purposes of concluding and fulfilling the contract, we mainly process the identification and contact data of the person concerned. Legal basis: the processing of personal data is necessary for the performance of a contract to which the data subject is a party, or for the implementation of a pre-contractual measure at the request of the data subject within the meaning of Art. 6 par. 1 letter (b) the GDPR Regulation.
The provision of personal data is necessary for the conclusion of the contract. If personal data is not provided, it is not possible to enter into a contractual relationship. Personal data is processed for the duration of the contractual relationship, or for the duration of legal claims.
  • Accounting and tax purposes
    
For the purposes of fulfilling the legal obligation of the Operator, personal data are processed to the extent specified by the relevant legislation. The legal basis for the processing of personal data is the fulfillment of the legal obligations of the Operator in accordance with Art. 6 par. 1 letter (c) the GDPR Regulation. The processing of personal data is a legal requirement, the processing of personal data is stipulated by a special regulation. Personal data is stored for a period specified by special regulations.
  • Ensuring the functionality and security of the website 

    For the purposes of ensuring the functionality and security of the website, the Operator may process an online identifier (eg IP address) and so-called cookies. The legal basis for the processing of personal data is the legitimate interest of the Operator in accordance with Art. 6 par. 1 letter (f) the GDPR Regulation. The legitimate interest of the Operator is to ensure the functionality and security of the website. Personal data is stored for the operating hours of the web portal.

Who is the recipient of personal data?

The personal data of the concerned person are processed by authorized employees of the Operator, who are bound by confidentiality and have been trained in the field of personal data protection. In some cases, personal information is provided to our contractual partners in the areas of accounting, administrative activities and website administration. At the request of the concerned person, the Operator shall provide data on which intermediaries are involved in the processing of the concerned person personal data. Furthermore, the personal data of the persons concerned may be provided to public administration bodies and state authorities in accordance with special regulations. When managing the Operator's profiles on social networks, the operator of a specific social network also has access to the data. What is the processing time for personal data?

Personal data are processed for the time necessary for the purpose of their processing; the duration of the contractual relationship, or the period of legal claims; duration of the legitimate interest, resp. until the data subject is objected to by the processing of personal data; the period stipulated by special regulations or an international agreement by which the Slovak Republic is bound. In the case of personal data processing on the basis of the consent of the data subject, until the time for which the consent was provided, resp. pending the withdrawal of such consent, without prejudice to the lawfulness of the processing based on the consent given prior to its withdrawal.

Is there a transfer of personal data to third countries or profiling?

The Operator does not carry out the transfer of personal data to a third country and is not subject to automated individual decision-making or profiling. However, in certain circumstances, the transfer of personal data to third countries may take place, especially in connection with the operation of the Operator's profiles on social networks. In this case, the operator of a specific social network (eg Facebook, Instagram) acts within the meaning of the GDPR Regulation as an independent operator, which determines the conditions of personal data processing and protection separately. What are the rights of the persons concerned?

  • Right to withdraw consent - if the processing of personal data is based on your consent, you have the right to withdraw your consent at any time without affecting the lawfulness of the processing based on the consent given before its withdrawal.
  • Right of access - you have the right to be provided a copy of the personal data we process about you, as well as information about how we use your personal data. Your personal data will be provided to you in the same form as you requested, if technically possible.
  • Right of rectification - we take reasonable steps to ensure the accuracy, completeness and timeliness of the information we have about you. If you believe that the information we hold is inaccurate, incomplete or out of date, please do not hesitate to ask us to modify, update or supplement this information.
  • Right of erasure - you have the right to ask us to erase your personal data, for example if the personal data we have obtained about you is no longer necessary to fulfill the original purpose of processing. However, your right must be assessed in the light of all the relevant circumstances. For example, we may have certain legal and regulatory obligations, which means that we will not be able to comply with your request.
  • Right to restrict processing - in certain circumstances you are entitled to ask us to stop using your personal data. These are, for example, when you think the personal information we hold about you may be inaccurate or when you think we no longer need to use your personal information.
  • Right of data transfer - in certain circumstances you have the right to request us to transfer the personal data you have provided to us to another third party of your choice. The right to portability, however only applies to personal data that we have obtained from you with your consent or under a contract to which you are a party.
  • Right to object - you have the right to object to the processing of data which is based on our legitimate interests. If we do not prove the necessary legitimate reasons for processing personal data that outweigh the interests, rights and freedoms of the data subject, or the reasons for defending a legal claim, and you file an objection, we will not process your personal data further.
  • The right to file a personal data protection procedure - if you think that we are processing your personal data unfairly or illegally, you can file a complaint with the supervisory body, which is the Office for Personal Data Protection of the Slovak Republic, Hraničná 12, 82007 Bratislava 27; e-mail: statny.dozor@pdp.gov.sk, www.dataprotection.gov.sk.
